The following movable property, which is kept in factory / Divisional office premises as shown below , attached under Panchanama dt.23.02.2007 under Section 142 of the Customs Act, 1962 read with Customs(Attachment of Property of Defaulter for Recovery of Government Dues)Rules 1995 as made applicable to like matters in central Excise by Notification No.68/63-C.E(N.T.)dt.04.05.1963 as amended in respect of the Unit / Factory mentioned below is proposed to be sold on “ as is where is basis” by way of open public Auction-cum-Tender to be held on the following date & time and place of auction given below :-

GENRAL CONDITIONS OF AUCTION TO BE HELD ON    06.03.2009

 

  1. The goods can be withdrawn from the Auction sale by Central Excise Department without assigning any reason.
  2. The bidders shall have to deposit Rs. Ten thousand only in form of Demand Draft as Security Deposit by 11.00 Hrs. on    06.03.2009 before commencement of the auction which  shall be liable for failure if the bidder fails to pay the amount bid by him , in the auction.
  3. The goods will be sold in the conditions in which it stands i.e.”As is where is basis” .The goods will be sold on assumption that bidders / tenderers have inspected the same and know what they are buying whether they have actually inspected the same or not.  The auctioneer does not give any guarantee or warrantee or undertakes any responsibility for the make, manufacture, description quality, condition, size , weight, grade accuracy, soundness and completeness of the goods.
  4. No sale shall be invalidated by reasons of any defect or fault in the goods or fault in description thereof in the auction notice.
  5. Local taxes including all Taxes, Sales Tax etc.if any will be payable by the purchaser of the goods at the rate in force.  The purchasers of the goods are also responsible for payment of arrears if any not paid earlier.  The entire responsibility of payment of above taxes , whenever and wherever applicable will be of purchasers only directly to the concerned Govt. department. Successful Bidder should indemnify the Commissioner of Customs & Central Excise, Nagpur for the payment of above taxes , whenever and wherever applicable.
  6. The persons interested to file Tender may submit the same in sealed envelop on or before 05.03.2009 during office hours.
  7. The sealed envelops will be opened by the auction committee at the beginning of the auction.
  8. Highest rate offered either by  tender or by auction will be accepted.
  9. On the fall of the hammer, the successful bidder shall pay the full amount or at least 25% of the accepted bid in cash or demand draft of Nationalized Banks only, drawn in favour of Commissioner of Customs & central Excise, Nagpur.
  10. If at the fall of hammer the higher bidders / tenderers fails to pay required money, the security deposit shall be forfeited.
  11. The balance of the amount of the bid alongwith Sales Tax at the rate in force shall be paid by the successful bidder by Draft in favour of Commissioner of Customs & Central Excise , Nagpur to the undersigned within three working days from the date of earliest earnest money paid.
  12. After payment of the balance amount as aforesaid, delivery can be taken within three working days failing which action will be taken as per condition of the auction.  In case the balance amount of the bid is not paid within specified period the earnest money paid by the bidder shall stand forfeited to the government and the bidder  will also forfeit all his rights in the goods for which he gave the bid and paid the earnest money of the bid.
  13. Delivery will be made only during the office working hours on working days.
  14. The purchaser will have to make his own arrangements for transport of the goods.
  15. In case of the examination of the goods , the purchaser will have to make his own arrangement at his own cost.
  16.          a) In certain case some bids may be accepted provisionally i.e. subject to confirmation by the Deputy Commissioner of Customs & Central Excise Division Bhandara. In all such cases all the above mentioned conditions shall also be applicable for such bids.  The successful bidder shall pay 25% of the bid amount by Demand Draft of any Nationalised Bank A/c in favour of the Commissioner of Customs & Central Excise Nagpur on the spot as earnest money.

 b)For subject to confirmation of the bid, the bidder has to inquire and get the confirmation from the office of the Deputy Commissioner, Customs & Central Excise Division Bhandara within three working days from the following day of auction.

    c)In case of acceptance/rejection of such provisionally accepted subject to confirmation bid, the formal intimation in writing by the auctioneer will be sent to the bidder under certificate of positing only.

     d) In case of rejection of such bids the refunds will be given to the bidder by the Central Excise Department in the same manner in which Rs.Ten Thousand was temporarily received for safe custody.

17.    The bidder are directed to give their correct names and detailed postal address.  No name  once given at the time of paying E.M.D. can be changed in the bid sheet.  The delivery order shall be issued in the name given in the bid sheet only and be received by the person who signed the bid sheet at the time of auction.

  1. The presiding officer in the auction reserves the right of removing any person for misbehavior.
  2.  The Deputy Commissioner of Central Excise & Customs , Division Bhandara reserves the right to reject any bid finally  accepted in the Auction without assigning any reason whether or not the bidder has paid full amount .
  3. All bidders / tenderers and purchasers shall be deemed to have read and be acquainted with these conditions of the sale and have given their bids , subject to these conditions.
  4. Special condition if any, will be announced by the Auctioneer at the auction sale.
  5. With permission of Chair it has been clarifies that the storage charges will be borne by the purchaser.
